The Waste Electrical and Electronic Equipment Act (ElektroG)

The law is primarily aimed at manufacturers, importers and distributors of electrical equipment, but also at consumers, who are obliged to separate waste and dispose of it properly. The foundation responsible for implementation is the stiftung elektro-altgeräte-register (stiftung ear).

WEEE

The ElektroG implements the European WEEE Directive 2012/19/EU into German national law.

It provides comprehensive regulation of electrical and electronic equipment, covering everything from placing it on the market to take-back and environmentally sound disposal. Its purpose is to encourage the reuse and recycling of waste equipment, thereby improving the use of resources.

The Act was first introduced in 2005 and has been revised several times since then:
  • ElektroG1 (2005): Introduction of basic obligations for producers and distributors, in particular regarding the registration and take-back of waste equipment.
  • ElektroG2 (2015): Extension of the scope to all electrical appliances, introduction of new types of appliances such as photovoltaic modules, and increased information requirements for producers and distributors. An authorised representative for companies not based in Germany will be mandatory
  • From 1 May 2019, so-called passive end devices – i.e. those that merely conduct electricity, such as sockets or light switches – will also be considered electrical or electronic equipment within the meaning of the Electrical and Electronic Equipment Act (ElektroG).
  • ElektroG3 (2022): Further adjustments, including improved collection of old appliances, removal of batteries and return of disposable electronic products such as e-cigarettes. In addition, consumer information has been standardised and return options expanded. For example, food retailers above a certain size are now also required to take back electrical appliances.

ElektroG4 (2026): The amendment is scheduled to come into force as early as January 2026. One significant change (innovation) is expected to be the obligation for retailers to take back so-called e-cigarettes.

Its purpose is to encourage the reuse and recycling of waste batteries and improve resource utilisation.

First introduced in 2009, the Act has undergone several revisions since then

2015: First amendment to the BattG to implement Directive 2013/56/EU. One of the aims was to improve take-back and disposal.

2021: BattG2 –
Comprehensive amendment to the law. Important changes:

  • Change from notification to registration requirement for proders at the Federal Environment Agency
  • Competition between take-back systems instead of a solidarity system
  • Involvement of the stiftunge ear for approvals and enforcement

06.10.2025: BattDG – The Battery Implementation Act (BattDG) comes into force and replaces the Battery Act (BattG).

EU-wide legislative amendment through the EU Battery Regulation (EU-BattVO)

The new EU Battery Regulation has been in force since August 2024 and replaced the previous directive on 18 August 2025. Unlike a directive, a regulation is immediately and directly applicable.

  • since 18 August 2024: all new batteries that are brought onto the market from this date must bear a CE mark
  • Since 06 October 2025, the Battery Implementation Act (BattDG) has been in force and implements the EU BattVO in Germany.

3 types of batteries become 5 battery categories:
  • The newly introduced battery categories are: portable batteries, starting, lighting and ignition batteries (SLI), light means of transportation batteries (LMT), electric vehicle batteries and industrial batteries
  • Batteries and accumulators must be registered with an indication of the chemical composition
The Authorised Representative becomes an obligation
  • Companies without a registered office in Germany must appoint an authorised representative for registration.

On June 12, 1991 The Packaging Ordinance (VerpackV) came into force in Germany. For implementation, the “Dual System Germany” (DSD) founded — known for the “Green Dot”. It was the first comprehensive take-back system for sales packaging in Germany.

In subsequent years, the Packaging Ordinance was amended several times (1990s-2010s):

Challenges:

  • Free riders: Many companies did not log on to the systems correctly.
  • Inefficiency and lack of transparency in the dual system.
  • Recycling rates stagnated in part.

Am January 1, 2019, the VerpackG came into force and replaced the Packaging Ordinance.

What's new:

  • Central Packaging Register Office (ZSVR): Supervisory body to monitor producers obligations.
  • Mandatory registration: Producers must register with ZSVR and report regularly how many quantities of packaging have been placed on the market.
  • Licensing requirement: Participation in a dual system remains mandatory. There are now various dual systems.
  • More transparency: Publicly available register of all registered companies (“LUCID”).

From July 1, 2022, amendment: All packaging, including packaging that is only delivered to final consumers (e.g. in the case of e-commerce), must be registered.

  • Mandatory reusable offer in restaurants (e.g. for coffee-to-go cups).

Clearer labeling requirements for packaging will follow.

Online platforms must prove that retailers are correctly registered on the platforms and have joined a dual system.

On August 12, 2026 If the PPWR (EU Packaging Ordinance) comes into force in Europe, this will lead to an amendment to the German Packaging Act.

Measures will gradually come into force until 2030.

Reduce packaging waste — both in absolute terms and per capita

Strengthen reusability and recyclability

Making packaging more sustainable overall

Preventing greenwashing — clear labeling and material rules

Harmonize the internal market — same rules for all EU states
